Real Estate Photography Terms & Conditions

SCHEDULING

As you're well aware, the real estate business often depends on other people's schedules. In order to maximize your/our valuable time, we request that photography appointments be submitted with as much notice as possible.

LATE ARRIVAL

We understand how fast-paced and dynamic the real estate industry is and things can change in an instant! If you're running late, please communicate with the photographer as soon as possible of your arrival intentions.

CANCELLATION, NO-SHOW, AND INCLEMENT WEATHER POLICY

If cancellation or re-scheduling is necessary, please do so with a minimum of 24 hours' notice. For severe weather that causes the cancellation of the scheduled photo shoot, your shoot may be rescheduled for a new date at the earliest available time.

PRIORITY SHOOT

Any photo shoot scheduled within 24 hours of the first contact is considered a Rush or Priority Shoot. The processing of photos can take up to 24 hours after the on-site photography for a standard photography package. If a Client needs the property shot and processed all within the same 24 hours, there will be an additional fee of $50 assessed.

HOME PREPARATION

The Client can help make the photography process go smoothly and make the home look its best in the photographs by doing some preparation before the photographer arrives.

The photographer will make a reasonable effort to remove litter, stray objects, etc. from the rooms; however please note that this does not include things like making beds or arranging furniture. Agents are expected to have the property staged and cleaned prior to the photo shoot. All properties will be shot "As Is".

When a house is photographed for a real estate listing, both the exterior and interior of the home, including all major rooms, will be photographed. If you have a specific preference, your input is important when choosing the best rooms and angles to photograph. Absent your input, the photographer will use their best judgment and experience to decide how best to photograph the property and the resulting images will be deemed acceptable. This includes determining subtle details such as whether lights will be on or off, blinds\curtains open or closed, fires in fireplaces, pool lights on or off, etc.

DELIVERY OF PHOTOS

The photography package will be delivered to the client within 24 hours after the actual shoot via electronic content delivery such as email, cloud-based storage, or integrated hosting system. The download link for photos will be provided via email.

BILLING AND PAYMENT

We work hard to get your images back to you as soon as possible, so we ask that you provide payment as soon as possible. After the shoot, you will receive an itemized invoice of services rendered. Our preferred method of payment is through Venmo, however we will also happily accept your payment online, or by cash or check at the time of the shoot. All checks should be made out to “Randy Van Photography”. For credit card transactions, a transaction fee will be applied.

MEDIA STORAGE

Due to the volume and size of photos, we will only save photo content for up to six months from the date of shooting the subject property. After that, the content will be removed from our archival storage. It is strongly recommended that you save the photos to your computer or other storage medium such as servers, Cloud-based systems, etc. After six months, the property will need to be re-shot if you happen to need that imagery of the home.

RIGHTS AND USAGE

All photograph images (Photos) produced for an Agent or Broker (Client) are granted with a single use, non-transferable, non-exclusive image license, which expires once the listing is sold, canceled, or reassigned to another agent. This license is granted only to the Client and Client's parent company, and not to any third party.

The Client may use the Photos for any and all marketing materials and campaigns associated with the sale of the property for the duration of the contract with the seller, and for the Client's self-promotion. The Photos may also be used by the Brokerage for the sole purpose of marketing the specific property photographed. These rights permit you to post the photographs of the property on multiple listing services and make the Photos available to your MLS listing.

Ownership of the Photos remains with the Photographer who retains the copyright, and all other rights, as applicable by law. The granting of this license does not imply a transfer of ownership. All digital products are provided to the Client under license only.

The Client may not:

  • Transfer the rights of the Photos. All other rights are reserved by the Photographer.
  • Sell, sub-license, give, lend, or sublet the whole or part of Photos, whatever its size and resolution, or distribute Photos to another party at any point during the listing agreement period, or if the listing expires.
  • Reverse engineer, decompile, or disassemble any part of the Photos or accompanying materials, subject to applicable law.
  • Copy or reproduce the Photos or accompanying materials. Remove any copyright or trademark from any place where it appears in the Photos files or embedded metadata.

The Photographer has the right to use these Photos for marketing and promotional materials, and to issue additional licenses to any third party for a fee. We agree not to use the Photos in a way that interferes with your rights.

Any usage of the Photos by an unauthorized third party, including but not limited to, architects, builders, stagers, designers, sellers or buyers, or their respective agents, is strictly prohibited unless approved in writing and\or licensed by the Photographer.

PROPERTY ACCESS

The Client authorizes the Photographer to come onto the Property and take exterior photographs in addition to authorizing entry into the dwelling to take interior photographs.
